STOP – Do not simply pay the fine!

Our law firm receives many calls from commercial drivers, motor carriers and owner/operators of trucking companies who incorrectly believe that by simply “paying the fine” on the overweight violation the ticket is resolved and they will never have to deal with it again.

That is not the case.

As stated in most court’s paperwork and website disclosures; when an individual simply pays the fine associated with the overweight ticket, the defendant is required to waive their right to jury trial and enter a plea of guilty or nolo contendere (no contest).

Please note that any traffic violation that is simply paid is reported as a conviction to the Texas Department of Public Safety (TXDPS).

FMCSA Implications When Ticketed for Overweight Violations in Texas

Under Federal Regulations, the Texas Department of Transportation (TXDOT) has fifteen (15) days to report all found violations to the Federal Motor-Carrier Comprehensive Safety Analysis (FMCSA) system implemented in 2010. This federal requirement includes all warnings and citations!

Contact our commercial driver defense lawyers today so we can discuss how you can dispute FMCSA violations. Remember that you only have fifteen (15) to request an appeal through the DataQ System. (hyperlink: https://dataqs.fmcsa.dot.gov/Default.aspx?enc=4orUr4VSakAlYsjxOmHrCeQ158IknHedB20QvqZJtcw=) Do not just pay the overweight violations since it may negatively impact your FMCSA score.

As of September 1st, 2013, fine amounts for overweight vehicles increased drastically.

The following is a table of fines that apply to overweight, non-permit loads operating on Texas highways:

AXLE WEIGHTS OVERLOADS / HEAVIER THAN ALLOWABLE

Overage:

  • Less than 2,500 pounds = fines up to $500.00
  • 2,500 to 5,000 pounds = fines up to $1,000.00
  • More than 5,000 Pounds = fines up to $2,500.00

GROSS VEHICLE OVERWEIGHT / HEAVIER THAN ALLOWABLE

Overage:

  • Less than 2,500 pounds = fines up to $500.00
  • 2,500 to 5,000 pounds = fines up to $1,000 .00
  • 5001 to 10,000 pounds = fines up to $2,500.00
  • 10,001 to 20,000 pounds = fines up to $5,000.00
  • 20,001 to 40,000 pounds = fines up to $7,000.00
  • More than 40,000 = up to $10,000.00

All fine amounts DOUBLE for a 3rd and subsequent offense in a one-year time period.

If you have already simply paid the fines and pled to a conviction, please contact our traffic ticket lawyers immediately since Texas law limits the time you have to re-open the case.
